1. PURPOSE AND SCOPE

This Acceptable Use Policy ("AUP") governs the use of the Oxygen Content Fusion platform (the "Platform" or "Service") operated by Syncro Soft SRL ("we", "us", "our"). This AUP applies to all users of the Platform, including:

  • Organizations that create Organization Workspaces
  • Administrators of Organization Workspaces
  • Invited users ("Authorized Users") who access Organization Workspaces
  • Any other person who accesses or uses the Platform

By using the Platform, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your access to the Platform, as well as potential legal action.

2. PROHIBITED CONTENT

You may not upload, post, transmit, store, or share, or otherwise create or generate (including through AI features of the Platform) any content that:

2.1 Illegal Content

  • Is illegal, promotes illegal activities, or violates applicable laws or regulations in the European Union, or any other jurisdiction where the Platform is accessed or used
  • Promotes, facilitates, or provides instructions for illegal activities, including terrorism, violence, drug trafficking, human trafficking, or fraud
  • Violates export control laws or sanctions regulations

2.2 Intellectual Property Infringement

  • Infringes, misappropriates, or violates any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any third party
  • Contains pirated software, or unauthorized copies of copyrighted materials
  • Circumvents or attempts to circumvent digital rights management (DRM) technologies

2.3 Harmful or Dangerous Content

  • Contains software viruses, worms, trojan horses, malware, spyware, ransomware, or any other malicious code or programs designed to interrupt, destroy, damage, or limit the functionality of any computer software, hardware, or telecommunications equipment

2.4 Harassing or Abusive Content

  • Is defamatory, libelous, or slanderous
  • Constitutes harassment, bullying, stalking, intimidation, or threats against any individual or group
  • Invades another person's privacy or violates their privacy rights
  • Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity

2.5 Hateful or Discriminatory Content

  • Promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, caste, sexual orientation, gender, gender identity, disability, age, or any other protected characteristic

2.6 Deceptive or Fraudulent Content

  • Is fraudulent, deceptive, misleading, or intended to scam or defraud others
  • Constitutes or promotes phishing, identity theft, or other forms of fraud
  • Contains false or misleading information intended to manipulate or deceive others

2.7 Spam and Unsolicited Content

  • Constitutes spam, including unsolicited bulk email

2.8 Sexually Explicit Content

  • Contains pornography, sexually explicit material, or graphic sexual content

3. PROHIBITED ACTIVITIES

You may not:

3.1 Unauthorized Access and Security Violations

  1. Attempt to gain unauthorized access to any portion of the Platform, other users' accounts, computer systems, or networks connected to the Platform through hacking, password mining, brute force attacks, or any other means.
  2. Circumvent or attempt to circumvent any security features, authentication measures, access controls, or technological protection measures implemented by the Platform.
  3. Probe, scan, or test the vulnerability of the Platform or any system or network connected to the Platform, or breach security or authentication measures.
  4. Access or use any portion of the Platform that you are not authorized to access, including attempting to access administrative areas, other users' workspaces without authorization, or confidential information.
  5. Share or distribute access credentials, authentication tokens, or login information that would allow unauthorized individuals to access the Platform.
  6. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform or any portion thereof, except to the extent such restriction is prohibited by applicable law.

3.2 Disruptive Activities

  1. Interfere with or disrupt the Platform, servers, or networks connected to the Platform, including through denial-of-service attacks, flooding, or crashing.
  2. Impose an unreasonable or disproportionately large load on the Platform's infrastructure through excessive API calls, automated scripts, or other means.
  3. Transmit or facilitate the transmission of any virus, worm, defect, trojan horse, malware, or any items of a destructive nature.
  4. Use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.
  5. Bypass, circumvent, or attempt to bypass or circumvent any rate limits, usage limits, or other restrictions imposed by the Platform.

3.3 Automated Access and Scraping

  1. Use any robot, spider, scraper, crawler, or other automated means to access the Platform for any purpose without our express written permission.
  2. Use automated tools to create accounts, submit content, or perform other actions on the Platform without authorization.
  3. Scrape, harvest, or collect data, content, or information from the Platform using automated or manual means, except through officially supported export or API features.
  4. Monitor or copy any content or information from the Platform using manual or automated means for competitive purposes or to create a competing service.

3.4 Misuse of Features and Services

  1. Use the Platform for any purpose other than its intended use as a collaborative document editing review, publishing, content organization, and communication platform, as made available by its features and documentation.
  2. Create multiple accounts to evade usage limits, circumvent bans or suspensions, or engage in fraudulent activity.
  3. Share a single user account among multiple individuals, or allow others to use your account.
  4. Use the Platform to store or distribute content unrelated to legitimate collaborative work, such as using it as a general-purpose file hosting or distribution service.
  5. Resell, sublicense, or provide access to the Platform to third parties without authorization, except as explicitly permitted for Authorized Users within your Organization Workspace.

3.5 Manipulation and Abuse

  1. Manipulate identifiers to disguise the origin of content or communications transmitted through the Platform.
  2. Impersonate any person or entity, or falsely state or otherwise misrepresent your identity or affiliation with any person or entity.
  3. Create false or misleading workspaces, profiles, or content designed to deceive other users.
  4. Engage in any activity that manipulates or attempts to manipulate the Platform's features, algorithms, or functionality for unauthorized purposes.

3.6 Data Mining and Competitive Use

  1. Use data, content, or information obtained from the Platform to develop, train, or improve competing products or services, or machine learning models that compete with the Platform.
  2. Extract or compile user lists, organization lists, or other aggregated data from the Platform for commercial purposes without authorization.
  3. Monitor the Platform to gather competitive intelligence or business information about us or our customers.

3.7 Violation of Third-Party Rights

  1. Violate the privacy rights of others, including collecting, using, or disclosing personal information without proper consent or legal basis.
  2. Violate contractual rights you have with third parties, such as confidentiality agreements or employment agreements.
  3. Engage in any activity that violates the rights of third parties, including but not limited to intellectual property rights, privacy rights, publicity rights, or contractual rights.

4. COMPLIANCE WITH LAWS

You must comply with all applicable local, national, and international laws and regulations in your use of the Platform, including but not limited to:

  • Data Protection Laws: GDPR and any other applicable data protection and privacy laws.
  • Export Control Laws: EU export regulations, US export control laws (if applicable), and any other applicable export and sanctions laws.
  • Intellectual Property Laws: Copyright laws, trademark laws, patent laws, and other intellectual property laws.
  • Anti-Corruption Laws: UK Bribery Act, the US Foreign Corrupt Practices Act (if applicable), and other applicable anti-corruption laws.
  • Industry-Specific Regulations: Any laws or regulations specific to your industry or business, such as healthcare regulations (HIPAA, if applicable), financial services regulations, or other sector-specific requirements.
  • Employment and Labor Laws: Applicable laws governing your relationship with Authorized Users who are your employees or contractors.

You are solely responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction and the jurisdictions of your Authorized Users.

5. RESOURCE USAGE LIMITS

To ensure fair access and optimal performance for all users, we impose reasonable limits on resource usage, including:

  • Storage limits based on your subscription plan
  • API rate limits to prevent abuse and ensure system stability
  • Number of users based on your subscription plan
  • Upload sizes for individual files or documents
  • Bandwidth usage limits to prevent excessive resource consumption

Attempting to circumvent these limits through technical means is prohibited and may result in immediate suspension or termination.

We reserve the right to implement additional usage limits as necessary to maintain Platform performance and security.

6. MONITORING AND ENFORCEMENT

6.1 Our Rights to Monitor

We reserve the right, but have no obligation, to:

  1. Monitor use of the Platform to detect violations of this AUP, though we do not systematically review user content for compliance.
  2. Investigate suspected violations of this AUP, including reviewing content, access logs, and user activities.
  3. Cooperate with law enforcement authorities investigating illegal activities conducted through the Platform.
  4. Use automated tools and manual review to identify potentially violating content or activities.

6.2 No Obligation to Monitor Content

We are not responsible for monitoring or policing content uploaded by users, and we are not liable for user content or user activities. The responsibility for ensuring compliance with this AUP rests with users.

We act as a service provider and intermediary, not as a publisher or editor of user content. We do not endorse, approve, or adopt any user content.

6.3 Enforcement Actions

If we determine, in our sole discretion, that you have violated this AUP, we may take any or all of the following actions:

  • Issue a warning and require you to remove or modify violating content.
  • Temporarily suspend your access to the Platform while we investigate the violation.
  • Restrict or limit certain features or capabilities of your account.
  • Terminate your access to the Platform immediately, with or without notice.
  • Remove or disable access to violating content without notice to you.
  • Report the violation to law enforcement authorities if we believe illegal activity has occurred.
  • Pursue legal action against you for damages or injunctive relief.
  • Notify your organization (if you are an Authorized User) of the violation.

The specific enforcement action will depend on the nature and severity of the violation, your history of compliance, and other relevant factors.

6.4 Appeals Process

If you believe we have taken enforcement action against you in error, you may appeal by contacting us at security@oxygenxml.com with a detailed explanation of why you believe the action was incorrect.

We will review appeals in good faith but reserve the right to make final determinations about AUP violations. Our decisions regarding AUP violations and enforcement actions are final and binding.

7. REPORTING VIOLATIONS

7.1 How to Report Violations

If you become aware of content or activities on the Platform that violate this AUP, please report them to us promptly at: Email: security@oxygenxml.comSubject Line: "AUP Violation Report"

Please include in your report:

  • A description of the violation and which provision of the AUP is being violated
  • The specific location of the violating content (URLs, workspace names, document names, etc.)
  • Screenshots or other evidence of the violation, if available
  • Your contact information so we can follow up if necessary
  • Any additional context that would help us investigate the report

7.2 Anonymous Reporting. We accept anonymous reports, but providing your contact information helps us investigate more effectively and provide you with updates on the status of your report.

7.3 False Reports. Making false or malicious reports of AUP violations is itself a violation of this AUP and may result in enforcement action against you.

7.4 Our Response Process

We will investigate all reports of AUP violations in a timely manner, typically within 5 business days of receiving a complete report.

We may contact you for additional information if needed to complete our investigation.

We will take appropriate action based on our findings, but we are not obligated to inform you of the specific actions taken against other users.

8. INTELLECTUAL PROPERTY INFRINGEMENT

8.1 Copyright Infringement (DMCA Process)

If you believe that content on the Platform infringes your copyright, please submit a notice to our designated copyright agent at dmca@oxygenxml.com with the following information required by the Digital Millennium Copyright Act (DMCA) and EU Copyright Directive:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material and information sufficient to locate it on the Platform
  • Your contact information (address, telephone number, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

8.2 Counter-Notice

If you believe that content you uploaded was removed in error due to a copyright claim, you may submit a counter-notice to dmca@oxygenxml.com with:

  • Your physical or electronic signature
  • Identification of the removed content and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the content was removed in error or misidentification
  • Your contact information
  • A statement consenting to jurisdiction of the courts in Romania or your local jurisdiction

8.3 Repeat Infringer Policy.

We will terminate the accounts of users who are determined to be repeat infringers of intellectual property rights in accordance with our repeat infringer policy.

9. MODIFICATIONS TO THIS AUP

We may modify this AUP at any time by posting the revised version on our website and updating the "Last Updated" date at the top of this document.

If we make material changes to this AUP, we will notify users by email or by posting a prominent notice on the Platform at least 30 days before the changes take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised AUP. We encourage you to review this AUP periodically to stay informed about our policies regarding acceptable use.
