As Mike Kay said,

Since Saxon 8 is an XSLT 2.0 processor, you can drop the xx:node-set() 
extension function.

So, for example,

<xsl:variable name="v2">
  <xsl:apply-templates select="xx:node-set($v1)" mode="phase2"/>
</xsl:variable> 

can be 

<xsl:variable name="v2">
  <xsl:apply-templates select="$v1" mode="phase2"/>
</xsl:variable>
