I found a solution, thought I'd share it
I'm using
instead of <xsl:sort order="{$sorder}" select="[@name()=$sterm]" />
this allows full paths to be used as opposed to the original sort

<xsl:sort order="{$sorder}" select=" texte/fichetitre[$sterm='a'] | texte/typeheberg[$sterm='b'] | region/regionnseo[$sterm='c'] "/>
instead of <xsl:sort order="{$sorder}" select="[@name()=$sterm]" />
this allows full paths to be used as opposed to the original sort
