Normally I'd use separate templates rather than an xsl:choose:

        <xsl:apply-templates/>
      </li>
</xsl:template>



<xsl:template match="sub2/note">
      <li>
        <xsl:apply-templates/>
      </li>
</xsl:template>



<xsl:template match="sub3/note">
      <li>
        <xsl:apply-templates/>
      </li>
</xsl:template>
