<xsl:template match="processing-instruction()|text()|@*">
<xsl:copy-of select="."/>
</xsl:template>


firstly you shouldn't have to sort non-element nodes since the sort
criteria is an attribute. and you can usually get clearer stylesheets
by trying to make more specific templates.
