It will be parsed by an XML parser before being passed to teh script engine, so the script engine will see &. If you are writing HTML, then use <xsl:output method="html" and XSLT will write out & as & inside <script and <style elements automatically. If you are writing a javascript file, use <xsl:output method="text" and XSLT will write out & as & inside <script and <style elements automatically.
