Right David.... maybe time to add a XSLT2 alternative?

The right thing is to have a list as part of the paragraph if it is part of the sentence. It is HTML's content model for p that is wrong.

If however, you do need to split up the p to spit out the lists you will find some code in, er, the xslt faq maintained by, er, you....
