Correct, however, when the Indent=yes feature inserts white space in the
element it becomes a different, and invalid for an EMPTY element.

  Rather than the expected form of
  <ERROR a='data' .../>


They are specified as being the same thing in the XML spec
No XML application will distinguish them. An XSLT system may output them in
either form.
