Tony Graham wrote the stylesheet back when XSLT was still in its infancy (as opposed to being a toddler), when using the MS "XSL" was perhaps more forgiveable than it is now (since at least MS was supporting it). Since the MS "XSL" doesn't have functions to report back the processor and version, the stylesheet does its best to infer what it can.

If you find this too cunning for words, blame Tony.

The "literal result element as stylesheet" feature is described in the XSLT spec, section 2.3.
