The distinction in this case is that attributes are not in the child axis from the element, but the element is in the parent axis from the attribute. The other cases you mention (all of which get the answer yes) do not have such an `axis conflict' pi's, text, comments and elements are all children of their parent element (or the root) and siblings of each other.
